Terms of Service
Last updated: September 18, 2026
These Terms of Service (“Terms”) govern your use of sandiegotrailcompany.com and your participation in any guided trail ride, riding lesson, kids camp, equine-assisted coaching session, ranch stay, or event (each an “Activity”) offered by San Diego Trail Company (“we,” “us,” “our”). By using this site or booking an Activity, you agree to these Terms. If you do not agree, please do not use the site or book with us.
Who we are
San Diego Trail Company operates a working ranch at 14875 Mina De Oro, Poway, CA 92064. We can be reached at 858-748-6441 or ride@powayequestriancenter.com.
Inherent risks of equine activities
Horses are large, powerful animals with independent will, and no amount of skill, training, or care can eliminate the unpredictability of working with them. By participating in any Activity involving a horse, you acknowledge and accept that you may be exposed to risks including, but not limited to:
- A horse bucking, rearing, biting, kicking, bolting, stumbling, or reacting unpredictably to sounds, movement, other animals, terrain, or unfamiliar objects.
- Falling or being thrown from a horse, or a horse falling, rolling, or losing its footing.
- Collision with, or being struck, stepped on, or crushed by, a horse or another rider, whether mounted or on foot.
- Uneven, steep, muddy, rocky, or otherwise hazardous natural terrain on guided canyon and backcountry trails.
- Exposure to sun, heat, cold, insects, wildlife, and other outdoor and ranch-environment conditions.
- A rider's own action or inaction, misjudgment, failure to follow instructions, or physical limitations.
These risks cannot be eliminated regardless of the care taken to avoid injuries, and you voluntarily assume them by choosing to participate. Riders should have no known cardiac, respiratory, back, or other medical condition that could be aggravated by horseback riding, and should tell staff about any condition, pregnancy, or physical limitation before mounting.
Liability waiver required before participation
Every participant — or, for a minor, that minor's parent or legal guardian — must read, sign, and submit our separate Liability Waiver and Release of Claims before mounting a horse or beginning any Activity, in addition to agreeing to these Terms. That waiver form, not this page alone, is the document releasing us from liability for the inherent risks described above and for our ordinary negligence to the fullest extent allowed by California law. We will provide it to you before your visit or ask you to sign it on arrival; a ride or lesson cannot begin until it is completed.
Nothing in these Terms or in that waiver releases us from liability for gross negligence, recklessness, or intentional misconduct, or limits any right that cannot be waived under California law.
Eligibility, fitness, and rider conduct
- Guided trail rides are generally offered to riders age 7 and up; some Activities have their own age, weight, height, or experience requirements, which we will tell you at booking.
- Riders under 18 must be accompanied by, or have written consent from, a parent or legal guardian.
- We may refuse or end participation for anyone who appears intoxicated, is unable to follow safety instructions, or whose conduct puts themselves, other guests, staff, or a horse at risk — no refund is owed in that case.
- You must follow our guides' instructions at all times, wear any safety equipment provided, and disclose any relevant medical condition, medication, pregnancy, or limitation before the Activity begins.
- Closed-toe shoes with a heel are required to ride. Long pants are strongly recommended.
Bookings, payment, and cancellation
Activities are booked and paid for through FareHarbor, our third-party reservation provider, under FareHarbor's own terms in addition to these Terms. Pricing, deposit, cancellation, and weather/reschedule policies are shown at the time of booking in FareHarbor's checkout flow — please read them before you pay, since they control refund eligibility. Gift certificates sold through our shop are redeemable toward Activities and are non-refundable for cash once purchased.
Limitation of liability
To the fullest extent permitted by California law, and except for our gross negligence, recklessness, or intentional misconduct: (a) San Diego Trail Company, its owners, employees, guides, and agents are not liable for any injury, death, property damage, or other loss arising from or related to an Activity or use of this website; and (b) if liability is found despite the foregoing, our total liability to you for any claim arising out of an Activity or this website will not exceed the amount you paid us for that Activity.
We are not liable for indirect, incidental, consequential, or punitive damages, including lost enjoyment of a trip or event, even if we have been advised such damages are possible. Some jurisdictions do not allow certain limitations on liability, so parts of this section may not apply to you.
Indemnification
You agree to indemnify and hold us harmless from any claim, damage, or expense (including reasonable attorney's fees) arising from your breach of these Terms, your violation of any law, or your negligent or intentional act or omission during an Activity or while on our property.
Photography and video
We may photograph or video guests during Activities for our marketing, website, and social media, and by participating you consent to that use without compensation, unless you tell staff in writing beforehand that you decline. To request removal of an existing photo or video, contact us using the details below.
Using this website
You agree to use sandiegotrailcompany.com only for lawful purposes: not to interfere with its operation or security, not to scrape or misuse its content, and not to submit false or fraudulent booking or contact information. Content on this site — text, photos, and design — belongs to San Diego Trail Company or its licensors and may not be reused without permission. See our Privacy Policy for how we handle information collected through the site.
Disclaimer of warranties
This website and our Activities are provided “as is.” We do not warrant that the site will be uninterrupted or error-free, and we make no warranty about the outcome or fitness of any Activity for a particular purpose beyond what is stated at booking.
Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. Any dispute arising out of these Terms or an Activity will be resolved in the state or federal courts located in San Diego County, California, and you consent to that venue and jurisdiction.
Severability
If any part of these Terms is found unenforceable, the rest remains in full effect, and the unenforceable part will be read to most closely reflect its original intent within the limits of the law.
Changes to these Terms
We may update these Terms as our Activities, policies, or the law change. We will revise the date at the top of this page when we do. Continuing to use the site or book an Activity after an update means you accept the revised Terms.
